These Terms of Service (“Terms”) apply to all orders placed through and all use of the online store operated at www.yuvanaya.com (“Website”).
By using this Website and/or placing an order, you agree to these Terms.

If you do not agree, please do not use the Website.

2. Scope and Definitions

  1. These Terms apply to all contracts concluded between Kabataan Cosmetics GmbH and its customers via the Website.
  2. A “consumer” is any natural person acting for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).
  3. Conflicting or deviating terms of the customer do not apply unless expressly agreed in writing by Kabataan Cosmetics GmbH.

3. Products and Information

  1. The Website offers cosmetic and skincare products (“Products”).
  2. Product descriptions, images, and information are provided with due care. Minor deviations, particularly in packaging or appearance, may occur and do not constitute defects.
  3. All Products are subject to availability.

4. Ordering Process and Contract Conclusion

  1. The presentation of Products on the Website does not constitute a legally binding offer, but an invitation to submit an order.
  2. By completing the checkout process and clicking the purchase button, you submit a binding offer to purchase the Products.
  3. A contract is concluded when we confirm your order by email or dispatch the goods, whichever occurs first.
  4. Order details are provided by email. We store the contract text in accordance with legal requirements.

5. Prices, VAT and Shipping Costs

  1. All prices are stated in EUR and include statutory VAT, unless otherwise indicated.
  2. Shipping costs are shown separately during checkout before the order is finalized.
  3. For deliveries outside the European Union, additional customs duties, taxes, or fees may apply and are the responsibility of the customer.

6. Payment

  1. Available payment methods are displayed during checkout.
  2. We reserve the right to limit payment methods in individual cases.
  3. If third-party payment providers are used, their terms and conditions may apply in addition.

7. Delivery and Shipping

  1. Delivery areas and estimated delivery times are stated on the Website or during checkout.
  2. Delivery times are non-binding unless expressly agreed otherwise.
  3. Delays caused by circumstances beyond our control, such as force majeure or logistics disruptions, may extend delivery times accordingly.

8. Retention of Title

The goods remain the property of Kabataan Cosmetics GmbH until full payment has been received.

9. Right of Withdrawal — Consumers in the EU

Consumers in the European Union have a statutory 14-day right of withdrawal.
Details regarding withdrawal, returns, refunds, and applicable exceptions are set out in our Return & Refund Policy, which forms an integral part of these Terms.

10. Exclusion of Withdrawal for Hygiene Products

For reasons of health protection and hygiene, the right of withdrawal does not apply to sealed cosmetic products once unsealed after delivery, unless the product is defective.
This is in accordance with Article 16(e) of Directive 2011/83/EU.

11. Warranty and Statutory Rights

  1. Statutory warranty rights under German and EU law apply.
  2. In the event of defects, consumers may be entitled to repair, replacement, price reduction, or withdrawal in accordance with legal provisions.

12. Liability

  1. We are liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
  2. In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable, typical damages.
  3. Mandatory statutory liability, including under product liability law, remains unaffected.

13. Website Availability and Changes

  1. We reserve the right to modify or discontinue the Website or individual features at any time for technical, legal, or operational reasons.
  2. Continuous, uninterrupted availability of the Website cannot be guaranteed.

14. Intellectual Property

All content on the Website, including text, images, product designs, graphics, logos, and trademarks, is protected by intellectual property law.
Any use beyond statutory permissions requires prior written consent from Kabataan Cosmetics GmbH.

15. Customer Accounts — If Applicable

  2. For consumers, this choice of law does not limit mandatory consumer protection rights of the country of residence.
  3. For merchants and legal entities, the place of jurisdiction is Germany, unless mandatory law provides otherwise.

21. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected.
